1. About Olearium
This website and online shop are operated by Olearium.
For questions about these Terms & Conditions, please contact us:
Email: info@olearium.ch
Telephone: +41 76 391 31 34
2. Scope
These Terms & Conditions apply to purchases made through the Olearium online shop and to related services provided by Olearium.
Separate written terms may apply to wholesale orders, hospitality partnerships, corporate gifting, private tastings and other business-to-business arrangements.
By placing an order, you confirm that you have read and accepted these Terms & Conditions.
3. Products and availability
We aim to present our products, origins, bottle sizes, ingredients and images as accurately as possible.
Because olive oil is an agricultural product, natural differences in colour, aroma and flavour may occur between harvests. Screen settings may also affect how product colours appear online.
All products are subject to availability. If an ordered product becomes unavailable, we will contact you and offer a suitable alternative or refund the affected amount.
4. Prices
All prices are shown in Swiss francs (CHF) and include Swiss VAT where applicable.
Delivery charges and any optional costs are shown separately before an order is submitted. Olearium may update its prices at any time, but a price change will not affect an order that has already been accepted.
5. Orders and contract formation
Before submitting an order, you can review and correct the products, quantities, billing information, delivery information and total price shown at checkout.
By selecting the final purchase button, you submit a binding offer to purchase the products in your order.
We will send an email confirming that the order has been received. This acknowledgement does not automatically mean that the order has been accepted. A contract is formed when Olearium sends an order confirmation accepting the order.
We may decline or cancel an order if:
- Payment cannot be authorised.
- A product is unavailable.
- Product or pricing information contains an obvious error.
- The order appears fraudulent or unlawful.
- Delivery cannot reasonably be completed.
If payment has already been collected for a cancelled order, the affected amount will be refunded.
6. Payment
Payment must be made using one of the methods displayed during checkout.
Payments may be processed by an independent payment provider under its own terms and privacy policy. Olearium does not intentionally store complete payment-card details on its own systems.
7. Delivery
Olearium currently delivers within Switzerland.
Available delivery options, charges, estimated times and procedures for delayed, damaged or missing parcels are described in our Delivery Policy.
Delivery dates are estimates and cannot be guaranteed. Delays may occur because of carrier disruption, severe weather, incorrect delivery information or other circumstances outside our reasonable control.
8. Returns, defects and refunds
Requests for voluntary returns must be made within 30 days of delivery. Eligible products must be unused, unopened and returned in their original packaging.
Because olive oil is a food product, opened bottles and products with broken seals cannot be returned unless they are defective, damaged or were supplied incorrectly. Personalised products and gift cards are also non-returnable unless required by law.
Further instructions are provided in our Returns Policy.
Nothing in these Terms limits any mandatory rights relating to defective, damaged or incorrectly supplied products.
9. Event reservations
Event places are limited and subject to availability. A reservation is confirmed once the required payment has been received and a confirmation has been issued.
Unless different conditions are shown for a particular event:
- Cancellations made at least seven days before the event are eligible for a refund.
- Cancellations made less than seven days before the event are non-refundable.
- A reservation may be transferred to another person if Olearium is informed before the event.
- No-shows are non-refundable.
Olearium may make reasonable changes to an event programme, venue, host or featured products.
If Olearium cancels an event, affected guests will be offered a full refund or the option to attend a rescheduled event.
10. Product information and responsible use
Customers are responsible for reviewing product labels, ingredients, best-before information and any dietary or allergen information before using a product.
Please contact us before ordering if you require clarification about a product.
Olive oil should be stored tightly closed in a cool, dark place away from direct sunlight and heat.
11. Intellectual property
The Olearium name, website copy, branding, graphics, photographs, product presentation and other website materials are protected by applicable intellectual-property laws.
These materials may not be copied, reproduced, distributed or used commercially without prior written permission from Olearium, except where permitted by law.
12. Liability
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.
To the extent permitted by applicable law, Olearium is not responsible for indirect or unforeseeable losses or for delays and failures caused by circumstances outside its reasonable control.
Nothing in this section affects the mandatory statutory rights of consumers.
13. Personal data
Personal data is processed in accordance with our Privacy Policy and the choices made through the website’s cookie-preference tool.
14. Governing law and jurisdiction
These Terms & Conditions are governed by Swiss law.
Any mandatory consumer rights concerning applicable law or jurisdiction remain unaffected. Consumers retain any right to bring proceedings before a competent court provided by mandatory law.
15. Changes and contact
Olearium may update these Terms & Conditions to reflect changes in its services, business practices or applicable law.
The version in effect when an order is placed will apply to that order.
